THE COURT OF JUSTICE RULES AGAINST FRANCE, GERMANY AND IRELAND FOR FAILURE TO COMPLY WITH COMMUNITY LAW ON THE ENVIRONMENT

These three Member States failed to comply with the directive on the conservation of natural habitats and of wild fauna and flora.

France, Germany and Ireland ought to have forwarded to the Commission in good time lists of sites hosting certain types of habitats and information relating to those habitats.


Community law seeks to protect biodiversity within the European Union through the conservation of natural habitats and of wild fauna and flora (the 1992 'habitats' directive).

This objective can be achieved only through the establishment of a European ecological network of special areas for the conservation of the habitats of protected species ('Natura 2000' network).

To that end, each Member State must designate sites as special areas of conservation.

In order to do so, they must forward to the Commission draft lists of sites of Community importance and information relating to those sites.

Since France, Germany and Ireland failed to forward those lists and information within the periods specified, the Court of Justice of the European Communities has ruled against them on the ground of failure to fulfil their obligations.
